Please read carefully before booking your appointment.

These terms and conditions will apply to anyone booking training or contacting Simon Dugdale Sports Therapy/Dover Sports Therapy/Just Breathe through the website, email, social media or by phone. Instructions by a client to commence personal training, sports massage therapy or any other service we may provide will constitute acceptance of these terms and conditions.  By booking your appointment with Simon Dugdale Sports Therapy/Dover Sports Therapy/Just Breathe the client accepts these Terms and Conditions.

The client is asked to pay special attention to the provisions related to liability and cancellations – this does not affect your statutory rights.

Payment

​

Payment will be made upon booking through the website via our bookings page.  If you call to book an appointment, full payment will be required to secure the booking.

​

Prices can be changed at any time.

​

All monies paid are non-refundable.

For Online Physical Rehabilitation Appointments Only

​

  1. Service Description:
    The online physical rehabilitation appointment includes a consultation and the creation of a tailored rehabilitation plan based on the information provided during the session.

  2. Limitations of Online Assessments:
    Please note that online assessments are conducted remotely and rely on the accuracy of the information and visuals provided by the client. As such, these assessments are not as comprehensive as in-person evaluations and may not capture all potential factors affecting your condition.

  3. Client Responsibility:
    Clients are responsible for providing accurate, up-to-date, and honest information regarding their medical history, current symptoms, and physical abilities. Any withholding of information may impact the effectiveness and safety of the recommended rehabilitation plan.

  4. Rehabilitation Plan:
    The plan provided is based on the online consultation and is designed to support your rehabilitation journey. However, it is not a substitute for in-person medical advice, diagnostics, or emergency care.

  5. Liability:
    While every effort is made to provide safe and effective advice, the service provider is not liable for any injury, harm, or adverse outcomes resulting from improper implementation of the rehabilitation plan or failure to disclose important health information.

  6. Follow-Up and Monitoring:
    Clients are encouraged to schedule follow-up sessions to monitor progress and adjust the rehabilitation plan as necessary. If any new symptoms or concerns arise, it is the client’s responsibility to seek appropriate medical attention.

  7. Consent:
    By booking an online appointment, you acknowledge that you understand and accept these Terms & Conditions and the inherent limitations of remote assessments.

For In-House Appointments Only - Arriving at the clinic

​

As a courtesy to all our guests we do operate a prompt appointment schedule. Please arrive at the clinic only five minutes prior to your scheduled appointment.  Please take a seat in Reception until you are called into the Treatment Room.

A late arrival may mean that your treatment time is reduced, you will still be charged the full price of the treatment.

Initial Consultation

​

Your first appointment will include an initial consultation and assessment, which may include a postural assessment, range of movement testing, muscle strength testing and test for ligament, tendon and/or meniscus damage. Due to this your treatment time during the first appointment will be 45 minutes and will include approximately a 30 minute treatment, however, assessment is important to be able to treat the cause as well as the symptoms and therefore may reduce the duration of the treatment.

The Trainer’s/Therapist’s Obligations

​

The trainer/therapist will use their skills and knowledge to design a safe programme of exercise or rehab exercises that will take into account the client’s personal goals, fitness levels and likes and dislikes related to exercise.

​

The trainer/therapist will provide the coaching, supervision, advice and support that the client may need to help them achieve their goals.

The Client’s Obligations

​

All client information will be kept strictly private and confidential. If the trainer requires further medical information from a practitioner, the client must provide such details.

​

It is understood between client and trainer/therapist that both must commit to the programme 100% in order to achieve results.

​

The client is required to arrive on time for each session so that a full session can be achieved on each visit.

​

The client is required to wear appropriate clothing. Clothes should be loose fitting and non-restrictive. A strict underwear rule is in place.

Health Screening/Medical History

​

All clients will be asked a number of questions before commencing any programme regarding their medical history and any ongoing medical issues.  Please be aware that there are medical issues that will not allow the Therapist to continue with treatment.  If you are concerned in any way, please call us for a discussion prior to booking your appointment.

​

Your trainer/therapist may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.

 

Your trainer/therapist cannot be held liable in any way for undeclared or unknown medical conditions.

Cancellation Policy

​

24 hours-notice of cancellation is required for all appointments that take place at the business premises. Rescheduling is permissible within a 1-week period of the original appointment without fees incurred. Notice of less than 12 hours will incur a full payment of the session fee with no option to reschedule.  No refund will be issued.

Lateness Policy

​

If the client is late for a session the session cannot be extended and will end at the appointed time.

​

If the trainer/therapist is late additional time will be added to the session or to subsequent sessions.

​

​

Liability

​

This Liability section applies only to the extent permitted by law. For the avoidance of doubt, Simon Dugdale Sports Therapy/Dover Sports Therapy Sports Therapy does not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Simon Dugdale Sports Therapy/Dover Sports Therapy’s negligence or wilful default, or (b) fraudulent misrepresentation.

Simon Dugdale Sports Therapy/Dover Sports Therapy does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, specifications and descriptions of listed packages and services. Simon Dugdale Sports Therapy/Dover Sports Therapy will correct errors and omissions as quickly as practicable after being notified of them.

Simon Dugdale Sports Therapy/Dover Sports Therapy does not accept any liability whatsoever for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and vehicles parked whilst on site and/or loss from claims of third parties arising out of the use of this website or services purchased from Simon Dugdale Sports Therapy/Dover Sports Therapy Sports Therapy or any other damage howsoever caused.

Simon Dugdale Sports Therapy/Dover Sports Therapy will only be liable for direct loss up to a maximum total of the price of the sessions or service purchased in respect of any claim.

​

Appointments booked via the Cliniko booking system will comply with Cliniko terms and conditions. by using Cliniko you agree to their terms and conditions. You can find a copy of their Data Processing Agreement on their website Cliniko.com.  Cliniko is GDPR compliant.

Miscellaneous

​

Simon Dugdale Sports Therapy/Dover Sports Therapy may amend these terms and conditions from time to time, and place the new version on the website. All sessions, subscriptions and purchases from Simon Dugdale Sports Therapy/Dover Sports Therapy from the date that the amended terms are placed on our website onwards will be governed by those new terms.

These terms and conditions shall apply when you use this website. They shall supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) whether oral or in writing.

​

Simon Dugdale Sports Therapy/Dover Sports Therapy advises that you print off and keep safe a copy of these terms and conditions. You are advised to read (and are responsible for reading) all information on this website fully.

If any of these terms are held to be invalid or unenforceable, those terms will be struck out and the other terms remain. These terms and conditions are subject to the laws and exclusive jurisdiction of the United Kingdom of Great Britain and Northern Ireland.
